1. Introduction
These Terms & Conditions (“Terms”) govern all sales, services, and related business carried out by Selkirk Mechanical Handling Ltd (“we,” “our,” or “the Company”). By placing an order, engaging our services, or otherwise dealing with us, you (“the Customer”) agree to be bound by these Terms.
2. Orders & Quotations
- All quotations are valid for 30 days unless otherwise stated.
- Orders are only binding once accepted in writing by Selkirk Mechanical Handling Ltd.
- We reserve the right to decline any order at our discretion.
3. Pricing & Payment
- Prices are subject to VAT at the prevailing rate unless otherwise stated.
- Payment terms will be agreed upon at the time of order. Unless otherwise agreed, payment is due within 30 days of invoice.
- Late payments may incur interest charges as permitted by law.
4. Delivery & Risk
- Delivery dates are given in good faith but are not guaranteed.
- Risk of goods passes to the Customer on delivery. Title to goods remains with Selkirk Mechanical Handling Ltd until payment is received in full.
5. Services & Maintenance
- Any service or maintenance work will be carried out with reasonable skill and care.
- Service schedules, callouts, and repair times are estimates and subject to availability.
6. Warranties & Liability
- Goods supplied are subject to the manufacturer’s warranty where applicable.
- Selkirk Mechanical Handling Ltd accepts no liability for indirect or consequential loss, including but not limited to loss of business, profits, or production.
- Nothing in these Terms excludes liability for death or personal injury caused by our negligence.
7. Cancellations & Returns
- Orders may only be cancelled with our written consent.
- Returned goods must be unused, in original packaging, and returned at the Customer’s expense unless faulty.
8. Confidentiality & Data Protection
- Any personal data provided will be handled in line with applicable data protection laws.
- We will not share your information with third parties except where necessary to deliver our services.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
